Article Submission Contest

OFFICIAL RULES

1. NO PURCHASE NECESSARY.

Void where prohibited or otherwise restricted by law.

2. CONTEST DESCRIPTION.

The Article Submission Contest (the “Contest”), which is sponsored by FindMyBusinessNow.com, Inc. t/d/b/a Gold Star Marketing Plans (the “Sponsor”) at SpoilTheGrandchildren.com (the “Website”), is a Contest where participants submit their articles to Sponsor for potential publication on the Website. This is an ongoing Contest where prizes are awarded based upon participation during each calendar month (“Contest Period”) identified by Sponsor from time to time.

3. PRIZES.

For each Contest Period, Prizes will be awarded by Sponsor with a retail value of up to U.S. $100. Those prizes may include:

  • One (1) gift card from a major retailer (e.g. Amazon.com gift card) in the amount of U.S. $100.
  • Up to four (4) other gift cards each in the amount U.S. $100 or less.
  • Such other prizes, if any, as Sponsor may unilaterally decide to award.

4. ELIGIBLE CONTESTANTS.

This Contest is open to most individuals who are grandparents, great-aunts, great-uncles, aunts, uncles, or parents of one or more minor children (biological or legally adopted).

To be eligible, you must also be eighteen (18) years of age or older and a legal resident of the United States, Canada, United Kingdom, Australia, or New Zealand.

However, if you have been convicted of (or pled guilty to) a crime involving dishonesty or moral turpitude, or are identified by the U.S. Department of Treasury’s Office of Foreign Assets Control as subject to sanctions or restrictions (click this link for more information), you are ineligible to participate in this Contest.

To ensure fairness, Sponsor’s owners, employees, and family members are also ineligible.

5. HOW TO COMPETE AND WIN.

Contestants will each submit an original article in the English language on the topic(s) assigned by Sponsor for a Contest Period. Such articles must meet the word count, formatting, and other requirements specified by Sponsor when announcing the topic(s) for the Contest Period. At time of submission, each contestant must also provide Sponsor with his/her legal name, mailing address, valid phone number, and email address.

Winners are determined by the number of unique votes each Contestant’s article receives during a Contest Period. Contestants may promote voting by friends, family, co-workers, etc. and in social media consistent with each platform’s terms and conditions.

Voting occurs at the Website and requires use of a voter’s valid email address. Voters must opt in to receive Sponsor emails in order to be a registered voter. However, a registered voter may opt out at any time after registering and voting.

No more than one vote per article may be cast by an individual during a Contest Period, with a maximum of 5 votes per Contest Period.

Sponsor reserves the unilateral right to disqualify from the Contest any Contestant who engages in inappropriate conduct (in Sponsor’s sole discretion). This includes, but is not limited to, violating the terms and conditions of social media sites while competing in the Contest. Plagiarism or using “black hat” tactics (e.g. voting with multiple email addresses by the same individual) will result in immediate disqualification.

Votes have no cash value and cannot be rolled over for use in a subsequent Contest Period. A submitted article cannot receive votes in more than one Contest Period.

Contestants may submit no more than one story per calendar month, and may win no more than once per calendar quarter.

6. INTERNAL VOTING BY SPONSOR’S OWNERS, AGENTS, AND EMPLOYEES.

Individuals who have a business relationship with Sponsor (and are ineligible to compete as Contestants themselves) will select the winners each Contest Period. They will be looking primarily at the aggregate number of votes acquired by each Contestant during a Contest Period. In the event of a tie in votes, Sponsor shall unilaterally determine the winner by evaluating the quality of each Contestant’s promotional activities in social media. Such decision shall be final.

7. PRIZE NOTIFICATION AND FORFEITURE.

Winners will be notified by email on or after the date a prize is awarded. To announce that a prize has been won by a Contestant, Sponsor will post a related announcement on the Website. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive email accounts, technical difficulties associated therewith, or a winner’s failure to adequately monitor his/her email account.

All prizes must be claimed within seven (7) calendar days of Sponsor’s sending notification of the prize to the winning Contestant (the “Claim Period”) by responding to notification email with correct mailing address and phone number. If a winner does not claim his/her prize during the Claim Period, the winner forfeits the prize, and another winner for that prize may be selected by Sponsor using the same notification and claim procedures as was used for the original winning Contestant who forfeited the prize. Claimed prize(s) will be mailed via USPS with signature required or delivered electronically from Amazon.com.

Each prize winner consents to the use of the winner’s name and agrees to provide Sponsor (upon Sponsor’s request) with a photograph of himself/herself for use by Sponsor in Sponsor’s advertising without additional compensation.

8. TAXES.

All taxes associated with the Prizes are the sole responsibility of each winner. Sponsor reserves the right to withhold any taxes as required by applicable law. All Prizes will be awarded (other than Prizes withheld for tax purposes as required by applicable law) and are not transferable. No substitutions (including for cash) are permitted, but Sponsor reserves the right to substitute a Prize of equal or greater monetary value to the prizes if for any reason any prize cannot be awarded as contemplated in these rules.

9. CONDITIONS OF PARTICIPATION.

By participating in this Contest, Contestant:

(a) agrees to and shall abide by these Contest Rules and the decisions of Sponsor shall be final in all respects;

(b) grants Sponsor without compensation a perpetual irrevocable worldwide license for the submitted article to publish on the Website and elsewhere, and create derivative works in all media formats; and

(c) consents to the use of winners’ names and likenesses and any statements, quotes or testimonials provided by the winners for advertising and publicity purposes without further compensation, except where prohibited by law.

Sponsor reserves the right to disqualify any Contestant or winner who, in Sponsor’s reasonable suspicion, hinders the entry or order process, violates these official rules, commits plagiarism, or acts in an unsportsmanlike or disruptive manner.

10. DISCLAIMER AND LIMITATION OF LIABILITY.

SPONSOR MAKES AND GIVES NO REPRESENTATIONS, CONDITIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE CONTEST OR ANY PRIZE OR ANY CONTESTANT’S PARTICIPATION IN THE CONTEST. SPONSOR SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, DAMAGE, COST, OR INJURY THAT ARISES FROM ANY OCCURRENCE, EVENT OR CONDITION OUTSIDE SPONSOR’S REASONABLE CONTROL THAT MAY AFFECT THE CONTEST OR CAUSE THE CONTEST TO BE DISRUPTED, SUSPENDED OR CORRUPTED, INCLUDING: (I) TELEPHONE, ELECTRONIC, HARDWARE OR SOFTWARE PROGRAM, NETWORK, INTERNET, OR COMPUTER MALFUNCTIONS, FAILURES, VIRUSES OR DIFFICULTIES OF ANY KIND; (II) FAILED, INCOMPLETE, GARBLED, OR DELAYED COMPUTER TRANSMISSIONS; AND (III) THE DOWNLOADING OF ANY MATERIAL IN CONNECTION WITH THIS CONTEST. SPONSOR RESERVES THE RIGHT, IN ITS SOLE DISCRETION AND WITHOUT PRIOR NOTICE, TO SUSPEND OR CANCEL THE CONTEST OR ALTER THE RULES IF AT ANY TIME A COMPUTER VIRUS, TECHNICAL PROBLEM, OR OTHER UNFORESEEABLE OCCURRENCE, EVENT OR CONDITION ALTERS OR CORRUPTS THE ADMINISTRATION OF THE CONTEST.

11. RELEASE.

BY PARTICIPATING IN THIS CONTEST, EACH CONTESTANT RELEASES AND AGREES TO HOLD HARMLESS SPONSOR AND ITS PARENT COMPANIES, SUBSIDIARIES, CONTESTANTS, DIRECTORS, OFFICERS, MEMBERS, EMPLOYEES AND AGENTS FROM ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, LOSSES OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, THOSE RELATED TO PERSONAL INJURY, DEATH, DAMAGE TO PROPERTY, INFRINGEMENT OF PROPRIETARY RIGHTS, RIGHTS OF PUBLICITY OR PRIVACY OR DEFAMATION), ARISING OUT OF OR IN CONNECTION: (I) ENTERING OR PARTICIPATING IN THE CONTEST; (II) ACCEPTANCE OR USE OF ANY PRIZE; OR (III) OTHERWISE ARISING OUT OF OR RELATING TO THE CONTEST.

12. GOVERNING LAW AND JURISDICTION.

The Contest and the rights and obligations of Sponsor and Contestants will be governed and controlled by the laws of the State of Minnesota applicable to contracts made and performed therein without reference to the applicable choice of law provisions. Any dispute, claim or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration before one arbitrator. The arbitration shall be administered pursuant to JAMS Streamlined Arbitration Rules and Procedures by a former state or federal judge selected by the parties. Judgment on the award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. Unless otherwise agreed to by Sponsor and Contestant, all arbitration must occur in Dakota County, Minnesota, USA. Arbitration fees and costs shall be split equally, and Sponsor and Contestant are solely responsible for their respective lawyer fees.

13. INTELLECTUAL PROPERTY.

All trademarks and service marks are the properties of their respective owners. Except for marks actually owned by Sponsor, Sponsor does not make any commercial claims to their use, and is not affiliated with them in any way. Unless otherwise expressly noted, including the retailers whose gift cards are provided as Prizes, none of the individuals, websites, or business entities mentioned herein has endorsed this Contest.

14. PRIVACY.

Sponsor is fully committed to protecting your privacy and respecting your choices. Should a Contestant decide to voluntarily supply Sponsor with personal information, it will be stored in Sponsor’s secure database, where appropriate procedures to safeguard the information are in place. All information supplied by a Contestant to social media sites are subject to the terms, conditions, and privacy policies of those social media sites.
